Legal Frameworks Governing Digital Consumer Protection in Indonesia: Evaluating Regulatory Effectiveness, Consumer Rights, and Governance in the Digital Economy

Abstract

The rapid growth of digital transactions and e-commerce in Indonesia has highlighted the need for a robust legal framework to protect consumers. This study examines the existing laws and regulations governing digital consumer protection in Indonesia, including the Consumer Protection Law (Law No. 8 of 1999), the Electronic Information and Transactions Law, the Personal Data Protection Law (Law No. 27 of 2022), and supporting government regulations. While these legal instruments provide foundational protection for consumer rights, data privacy, and transaction integrity, significant challenges persist, such as regulatory fragmentation, outdated norms, limited enforcement capacity, and the widespread use of complex click-wrap agreements. Additionally, Micro, Small, and Medium Enterprises (MSMEs) face difficulties complying with personal data protection regulations due to resource and technological constraints. This study argues that strengthening Indonesia’s digital consumer protection requires comprehensive regulatory reform, enhanced enforcement mechanisms, and the adoption of hybrid models that integrate legal frameworks with technological solutions, drawing lessons from international best practices. By addressing these gaps, Indonesia can create a more secure, transparent, and equitable digital marketplace, ensuring that consumers’ rights are protected effectively in the evolving digital economy.
